Das ProstSchG sieht nach § 32 eine Kondompflicht
und damit auch ein Werbeverbot für ungeschützte Praktiken vor.

Wir weisen darauf hin, dass die anwesenden Sex-Dienstleisterinnen (Mieterinnen) ihre Dienste als selbständige Unternehmerinnen anbieten und in keinem rechtlichen Tätigkeitsverhältnis zur "Asientraum Bad Oeynhausen" stehen.
Die Sex-Dienstleisterinnen werden ausschließlich im eigenen Namen und auf eigene Rechnung tätig.

Absprachen über die Art der Dienstleistung, die Höhe der Vergütung sowie die Modalitäten der Bezahlung finden ausschließlich zwischen den Sex-Dienstleisterinnen und deren Gästen statt und begründen kein Vertragsverhältnis und keine geschäftliche Beziehung mit "Asientraum Bad Oeynhausen".

Die Präsentation der Sex-Dienstleisterinnen (Mieterinnen) auf der Internetseite erfolgt ausschließlich im Auftrag und Namen der Sex-Dienstleisterinnen.

§ 32 Kondompflicht; Werbeverbot

(1) Kunden und Kundinnen von Prostituierten sowie Prostituierte haben dafür Sorge zu tragen, dass beim Geschlechtsverkehr Kondome verwendet werden.

(2) Der Betreiber eines Prostitutionsgewerbes ist verpflichtet, auf die Kondompflicht in Prostitutionsstätten, in sonstigen regelmäßig zur Prostitution genutzten Räumen und in Prostitutionsfahrzeugen durch einen gut sichtbaren Aushang hinzuweisen.

(3) Es ist verboten, durch Verbreiten von Schriften, Ton- oder Bildträgern, Datenspeichern, Abbildungen oder Darstellungen Gelegenheit zu sexuellen Dienstleistungen anzubieten, anzukündigen oder anzupreisen oder Erklärungen solchen Inhaltes bekannt zu geben

1. unter Hinweis auf die Gelegenheit zum Geschlechtsverkehr ohne Kondom, auch wenn der Hinweis in mittelbarer oder sprachlich verdeckter Form erfolgt,

2. in einer Weise, die nach Art der Darstellung, nach Inhalt oder Umfang oder nach Art des Trägermediums und seiner Verbreitung geeignet ist, schutzbedürftige Rechtsgüter der Allgemeinheit, insbesondere den Jugendschutz, konkret zu beeinträchtigen oder

3. unter Hinweis auf die Gelegenheit zum Geschlechtsverkehr mit Schwangeren, auch wenn der Hinweis in mittelbarer oder sprachlich verdeckter Form erfolgt.

Dem Verbreiten steht das öffentliche Ausstellen, Anschlagen, Vorführen oder das sonstige öffentliche Zugänglichmachen gleich.

Begründung zu § 32 (Kondompflicht; Werbeverbot)

Zu Absatz 1
Im Interesse der Prävention sexuell übertragbarer Erkrankungen und damit zum Schutz sowohl von Prostituierten als auch von deren Kunden oder Kundinnen sowie mittelbar betroffener Personen und der Allgemeinheit wird durch Absatz 1 eine Verpflichtung von Prostituierten und deren Kunden und Kundinnen zur Verwendung von Kondomen beim entgeltlichen Geschlechtsverkehr eingeführt. Unter Geschlechtsverkehr fallen neben dem vaginalen auch oraler und analer Geschlechtsverkehr.
Der Begriff des Kondoms impliziert die Anwendung am Körper des Mannes und zielt in erster Linie auf ein verantwortungsbewusstes Verhalten des Mannes ab; männliche Kunden und männliche Prostituierte sind folglich beim Geschlechtsverkehr im Rahmen der Kundenbeziehung stets verpflichtet, ein Kondom zu verwenden. Weibliche Prostituierte und Kundinnen sind ebenfalls Adressatinnen der Norm; sie sind verpflichtet, dafür Sorge zu tragen, dass beim Geschlechtsverkehr ein Kondom am Körper des männlichen Prostituierten oder Kunden zum Einsatz kommt. Daher sind auch sie als Verpflichtete des Kondomgebots aufgeführt.
Aus Sicht von Prostituierten bildet die Vorschrift eine Berufsausübungsregel, die jedoch – wie auch schon die bereits in zwei Bundesländern bestehenden landesrechtlichen Vorschriften – zum Schutz der genannten Rechtsgüter gerechtfertigt ist. Mit der Vorschrift werden vor allem Prostituierte gegenüber Kunden, Betreibern und Personen ihres Umfeldes darin bestärkt, zum eigenen Schutz auf der Verwendung infektionsschützender Sexualpraktiken zu bestehen und sich anderslautenden Kundenwünschen zu widersetzen, indem sie auf das Verbot verweisen. Die Vorschrift knüpft damit für ihre Implementierung am eigenen Schutzinteresse der Prostituierten an. Verstöße gegen die Kondompflicht sind daher für Prostituierte nach diesem Gesetz nicht bußgeldbewehrt, jedoch für Kunden und Kundinnen. Für die von mancher Seite geäußerte Befürchtung, die Kondompflicht solle durch Einsatz von „Scheinfreiern“ gegenüber Prostituierten mit Ordnungsmitteln durchgesetzt werden, ist damit kein Raum.

Die Verwendung von Kondomen ist das effektivste und einfachste Mittel, um das Risiko für sexuell übertragbare Krankheiten zu senken. Gleichwohl sind für Prostituierte (und deren Kunden und Kundinnen) auch darüberhinausgehende Kenntnisse über die Verwendung infektionsschützender Sexualpraktiken sinnvoll, denn allein durch eine Kondomverwendung beim Geschlechtsverkehr können einige Risiken sexuell übertragbarer Erkrankungen nicht sicher ausgeschlossen werden. Aus diesem Grunde ist es sinnvoll, zugleich den Zugang zu entsprechender zielgruppengerechter Beratung für Prostituierte zu erleichtern. Hierzu tragen u. a. entsprechende Informationen im Kontext der Anmeldung und der verpflichtenden Gesundheitsberatung nach § 10 sowie die Verpflichtung der Betreiber nach § 24 Absatz 3 bei, entsprechenden Beratungsangeboten Zugang zu ihrer Prostitutionsstätte zu gewähren.

Zu Absatz 2
Die in Absatz 2 vorgesehene Aushangpflicht dient dazu, die Einhaltung der Kondompflicht zusätzlich zu sichern. Nach § 24 Absatz 2 sind Betreiber verpflichtet, auf die Einhaltung der Kondompflicht hinzuwirken.

Zu Absatz 3
Zu Nummer 1
Die mit der Kondompflicht verfolgte Präventionswirkung lässt sich nur erzielen, wenn sich bei weiblichen und männlichen Prostituierten eine möglichst durchgängige Verwendung von Kondomen etabliert. Allerdings ist es derzeit für viele Prostituierte auch in den Bundesländern, in denen bereits eine Kondompflicht besteht, schwierig, gegenüber ihren Kunden auf einer Kondomverwendung zu bestehen, insbesondere wenn die Kunden durch die Verbreitung offener oder verklausulierter Werbung den Eindruck gewinnen, dass ungeschützter Geschlechtsverkehr ein „ganz normales“ und leicht aufzufindendes Angebot sei.
Zur Sicherung der Kondompflicht wird daher als selbständige Vorschrift ein explizites Werbeverbot eingeführt. Das Verbot erstreckt sich neben der expliziten Werbung für vaginalen, oralen und analen Geschlechtsverkehr „ohne Kondom“ auch auf szenetypische Abkürzungen wie beispielsweise „AO“, „FO“ oder sprachliche Umschreibungen wie z. B. „naturgeil“, „tabulos“.
Die Vorschrift schränkt auf Seiten der Prostituierten die Möglichkeit ein, im Wettbewerb Vorteile aus der Bereitschaft zu riskantem – und nach Absatz 1 verbotenem – Sexualverhalten zu ziehen. Sie reduziert den von der Nachfrageseite ausgehenden Druck zum Verzicht auf Kondome und dient damit zugleich der Stärkung von Prostituierten, die zum eigenen Schutz an der Kondomverwendung festhalten wollen.

Nummer 1 verfolgt dabei ein anderes Ziel als Nummer 2, wonach in erster Linie auf einen Schutz der Jugend und der Allgemeinheit vor unerbetener Konfrontation mit sexualisierten Inhalten abgezielt wird. Zwar kann seit Inkrafttreten des Prostitutionsgesetzes nicht mehr jede Form der Werbung für Prostitution als verboten angesehen und als Ordnungswidrigkeit verfolgt werden, es muss jedoch grundsätzlich weiterhin möglich sein, aggressiven und ausufernden Formen der Werbung für sexuelle Dienstleistungen entgegenzutreten. Dies soll durch die Regelung in Nummer 2 sichergestellt werden.

Zu Nummer 2
Nummer 2 umfasst das bisher in § 120 Absatz 1 Nummer 2 des Gesetzes über Ordnungswidrigkeiten normierte generelle Verbot, durch die dort genannten Medien für eine Gelegenheit zu entgeltlichen sexuellen Handlungen zu werben oder Erklärungen solchen Inhalts bekanntzugeben. Durch die Formulierung in Nummer 2 wird der Entwicklung der höchstrichterlichen Rechtsprechung zu § 120 Absatz 1 Nummer 2 des Gesetzes über Ordnungswidrigkeiten Rechnung getragen.
Werbung oder Bekanntgabe sind insbesondere dann nach Nummer 2 verboten, wenn sie geeignet sind, die Entwicklung von Kindern und Jugendlichen oder ihre Erziehung zu einer eigenverantwortlichen und gemeinschaftsfähigen Persönlichkeit zu gefährden. Nach den Urteilen des 1. Zivilsenats des BGH vom 13. Juli 2006 – I ZR 241/03 und I ZR 65/05 – ist aufgrund des Inkrafttretens des Gesetzes zur Regelung der Rechtsverhältnisse der Prostituierten vom 20. Dezember 2001 am 1. Januar 2002 sowie dem gewandelten Verständnis in der Bevölkerung an einem generellen Verbot jeder Werbung für entgeltliche sexuelle Handlungen nach § 120 Absatz 1 Nummer 2 des Gesetzes über Ordnungswidrigkeiten nicht mehr festzuhalten. Das Werbeverbot für Prostitution soll auf Fälle beschränkt werden, in denen durch die Werbung eine konkrete Beeinträchtigung von Rechtsgütern der Allgemeinheit, vor allem derjenigen von Kindern und Jugendlichen, vor den mit der Prostitution generell verbundenen Gefahren und Belästigungen eintritt. Die Werbung muss nach Aufmachung, Inhalt oder Umfang nicht in der gebotenen zurückhaltenden Form erfolgen oder nach der Art des Werbeträgers und seiner Verbreitung geeignet sein, die schutzbedürftigen Rechtsgüter zu gefährden. Auf die Eignung der Werbung
im Sinne des § 119 Absatz 1 des Gesetzes über Ordnungswidrigkeiten, andere zu belästigen, oder ihre Äußerung in grob anstößiger Form soll es nicht ankommen. Die Novellierung des Prostitutionsrechts gibt Gelegenheit, den Umfang des Werbeverbots für Prostitution, insbesondere im Interesse des Jugendschutzes, klarzustellen.
